MintServers Terms of Service

1. Service Description

MintServers, operated by MB Advancade (hereafter referred to as "we," "us," or "our"), is a Minecraft server hosting service registered in Lithuania. We provide customers (hereafter referred to as "you" or "your") with the infrastructure and tools to run Game servers.

2. Acceptance of Terms

By accessing or using MintServers, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use our services.

3. User Responsibilities

  1. Compliance: You must comply with Minecraft's End User License Agreement and all applicable local, state, national, and international laws and regulations.
  2. Content Management: You are solely responsible for the content, management, and use of your Minecraft server. This includes ensuring that all content, mods, and plugins do not infringe on any intellectual property rights or violate any laws.
  3. Account Security: You are responsible for maintaining the confidentiality of your account information and password. You agree to notify us immediately of any unauthorized use of your account.
  4. Backups: While we may provide backup services, you are ultimately responsible for backing up your server data.
  5. Age Requirement:
    • Users must be at least 16 years old to purchase and manage services
    • Users under 18 must have parental consent

4. Service Availability and Performance

  1. Uptime: We strive to maintain a high level of service availability but do not guarantee 100% uptime. Scheduled maintenance will be communicated in advance whenever possible.
  2. Performance: Server performance may vary based on factors such as server load, installed mods, and plugins. We do not guarantee specific performance metrics.
  3. Resource Usage Policy:
    • Excessive usage that impacts server performance or other users' experience may result in additional charges, service limitations, or account suspension.
    • RAM usage must not exceed the purchased plan limits
    • Backups are retained for 7 days after creation
  4. Backups ignore the following files:
    • Dynmap
    • mcmmo_data
    • .log files and anything ending in .log i.e. log.gz
    • .tar
    • Backup/MineBackup folders
    • .sql
    • Block logging data such as CoreProtect
    • .zip files in the root directory
  5. Hardware Specifications:
    • We advertise our services using representative hardware specifications that reflect the performance level of our infrastructure
    • Actual hardware may vary but will maintain similar or better performance levels
    • References to specific CPU models are for performance indication only
    • We reserve the right to upgrade or modify hardware configurations while maintaining comparable performance levels
  6. Fair Use RAM Policy:
    • Our hosting plans provide generous RAM resources designed to accommodate typical and demanding Minecraft server operations. All servers on applicable plans are allocated a baseline of 32GB of RAM.
    • Resources are provided on a fair-use basis within a shared hosting environment.
    • RAM usage is actively monitored to ensure the stability and performance of our shared infrastructure for all users.
    • Usage patterns that consistently consume disproportionate amounts of RAM, negatively impacting server performance, overall system stability, or the experience of other users, may be subject to review under this Fair Use Policy.
    • Factors considered in assessing fair use include, but are not limited to:
      1. Sustained high RAM consumption compared to typical server workloads.
      2. Usage patterns causing instability or performance degradation on the host node.
      3. Running server configurations or modifications known to have excessive memory requirements or leaks.
    • If your server's usage is deemed to be outside the scope of fair use, we will typically contact you first to discuss optimization options or potential resource needs.
    • In cases of persistent excessive usage negatively impacting the service, we reserve the right to implement temporary resource limitations or may require you to transition to a plan better suited for very high resource demands (such as our MAX plan) to maintain service quality for all customers. Continued abuse or refusal to address excessive usage may lead to suspension or termination as outlined in Section 12.
  7. DDoS Protection:
    • We provide DDoS mitigation as part of our service
    • Protection capabilities and methods may vary
    • We reserve the right to modify protection methods to maintain service stability

5. Payment and Billing

  1. Fees: All fees are due in advance for the selected service period. Current pricing is available on our website.
  2. Payment Methods: We accept most payment methods approved by Stripe.
  3. Auto-Renewal: Services are set to auto-renew by default. You may disable this in your account settings.
  4. Late Payments: We reserve the right to suspend or terminate services for non-payment. A reactivation fee may apply for suspended accounts.

6. Refunds and Cancellations

  1. Refund Policy: Refunds may be issued on a case-by-case basis at our discretion, typically for service outages exceeding 24 consecutive hours caused by factors within our control. Refunds are not available for issues caused by user actions (e.g., misconfigurations or excessive resource usage) or third-party software/plugins.
  2. Cancellation: You may cancel your service at any time through your account dashboard. No refunds will be issued for partial months of service.
  3. 24-Hour Money-Back Guarantee: If you are unsatisfied with our Minecraft hosting service, you may request a full refund **within 24 hours of your initial purchase** by contacting [email protected] with your order number. This guarantee applies **once per customer**, is valid **only on the initial subscription**, and does **not** apply to renewals, upgrades, or add-on purchases.

7. Donations

Our donation system lets an account holder publish a public donation page for a game server they host with us. In this section, the account holder who creates and runs a donation page is the "Page Owner" and anyone who donates through that page is a "Donor". By creating a donation page you accept this section, and you are asked to confirm this before the page is published.

  1. Our Role: We provide the donation page as a tool and we process the payment. We do not operate the game server, we do not decide what a donation page offers, and we are not a party to any agreement between a Page Owner and a Donor. We do not review, verify or endorse the goals, claims or rewards published on a donation page.
  2. Donor Status: Donating does not make a Donor our customer. It creates no account, no service entitlement, no support rights and no claim against us. Questions about a donation goal, a reward or the server itself must be raised with the Page Owner.
  3. Page Owner Responsibility: The Page Owner is solely responsible for the content of their donation page, for describing accurately what donations will be used for, for anything they offer in return, and for delivering it. Misleading Donors about the purpose or use of donations is a breach of these Terms.
  4. Game EULA Compliance: The Page Owner is solely responsible for ensuring that everything offered through their donation page, including any automated in-game reward, complies with the end user license agreement, commercial usage guidelines and any other rules of the publisher of the game they host. This includes the Mojang Studios Minecraft End User License Agreement and Commercial Usage Guidelines. We do not review, approve or monitor rewards. We accept no responsibility or liability for a Page Owner's breach of a publisher's rules, or for any action a publisher or rights holder takes against a Page Owner or their community as a result.
  5. How Donations Are Applied: Donations are credited to the Page Owner's MintServers account balance as service credit. That credit is not withdrawable, not transferable and not exchangeable for cash, and it is applied to invoices for services on that account.
  6. Donations Are Final: Donations are voluntary payments, not a purchase of goods or services from us, and they are non-refundable. The 24-hour money-back guarantee and the other refund provisions in these Terms do not apply to donations.
  7. Chargebacks and Reversals: If a donation is reversed, disputed or charged back after credit has been applied, we will deduct the corresponding amount from the Page Owner's account balance. Where the balance does not cover it, the amount becomes immediately payable by the Page Owner and we may add a handling fee to cover the costs charged to us by our payment provider. We may suspend the donation page, the related service or the account until the amount is settled, and repeated chargebacks may result in permanent removal of access to the donation system.
  8. Taxes: The Page Owner is responsible for determining, reporting and paying any tax arising from donations they receive. Tax on our hosting services is charged on our invoices in the normal way.
  9. Prohibited Use: Donation pages may not be used to collect money by deception, to fund illegal activity, to sell access or in-game advantages where the game publisher forbids it, to collect money for a server or project that is not hosted on the account, or to publish content prohibited elsewhere in these Terms.
  10. Our Rights: We may suspend, edit or remove any donation page at any time and at our discretion, with or without notice, including where we receive a complaint, suspect fraud or abuse, or consider that a page breaches these Terms or a publisher's rules. We may withhold or reverse credit connected to a page we suspend.
  11. Disputes Between Donors and Page Owners: Any dispute about a donation, a promised reward or the use of donated funds is between the Donor and the Page Owner. We are not obliged to mediate, investigate or compensate, and any assistance we choose to provide does not make us a party to that dispute.
  12. Indemnity: The Page Owner agrees to indemnify us and hold us harmless against any claim, demand, loss, cost, fine or penalty arising from their donation page, including claims brought by Donors, by game publishers or rights holders, and by payment providers.

8. Affiliate and Partner Program

We run a referral program with two tiers: the Affiliate Program, which is open to any account and pays commission as account credit, and the Partner Program, which requires an approved application and pays commission as withdrawable cash. The current rates, payout thresholds and other program details are published on the program pages. By claiming a referral link or applying for partnership you accept this section.

  1. Attribution: A referral is attributed to you when a visitor follows your referral link and places an order within the tracking window stated on the program pages (currently 30 days). Tracking uses cookies and requires a deliberate click on your link. Our tracking records are final in determining whether an order is attributed to you.
  2. Affiliate Credit: Commission paid as account credit can only be spent on services on your own account. It is not withdrawable, not transferable and not exchangeable for cash.
  3. Partner Payouts: Partners may request a payout once their available balance reaches the minimum stated on the program pages (currently $50). Payouts are processed within 14 business days. We may ask you to verify your identity or payout details before processing a payout.
  4. Prohibited Conduct: The following is treated as abuse of the program:
    • Self-referrals: using your own link for your own purchases, for purchases made by people in your household, or for accounts you own or control, and any arrangement whose main purpose is to route your own spending through the program.
    • Tracking abuse: cookie stuffing, forced or automated clicks, hidden iframes, typosquatting, or any script, extension or technique that sets or overwrites referral tracking without a deliberate click on your link.
    • Spam: promoting your link through unsolicited email or direct messages, mass or automated outreach, comment spam, or posting it in communities whose rules forbid it.
    • Brand bidding and impersonation: bidding on "MintServers" or confusingly similar terms in paid search, registering domains or social handles containing our name, or presenting yourself as MintServers instead of as an independent affiliate or partner.
    • Misleading promotion: false or exaggerated claims about our prices, features or performance, fabricated discounts, or presenting publicly available promotions as exclusive without our written approval.
    • Fraud: referrals generated with stolen payment methods, fake or duplicate accounts, or orders you have reason to believe will be refunded or charged back.
  5. Reversals: Commission only becomes payable on payments we have actually received. If a referred payment is refunded, disputed, charged back or otherwise reversed, the related commission is reversed with it. Where that commission has already been spent or paid out, we may deduct the amount from your balance or future earnings.
  6. Enforcement: We may withhold a payout while we investigate suspected abuse. Where we determine that commission was earned through conduct prohibited in this section, we may reverse it, remove you from the program and, in serious cases, suspend or terminate your account under Section 12. Commission earned through prohibited conduct is forfeited.
  7. Program Changes: We may change commission rates, payout thresholds and other program terms, or close the program, at any time. Changes apply to future payments, not to commission you have already earned.
  8. Taxes: You are responsible for reporting and paying any tax due on commission you receive.

9. Prohibited Activities

You are strictly prohibited from using our services for:

  1. Hosting or distributing illegal content, including but not limited to copyrighted material, malware, or content that promotes illegal activities.
  2. Circumventing or attempting to breach any of our systems or security measures.
  3. Sending unsolicited email (spam) or engaging in any form of harassment.
  4. Reselling our services without our express written permission.
  5. Exceeding agreed-upon resource limits or engaging in activities that negatively impact other users.
  6. Using servers for purposes other than running a Minecraft server (e.g., running custom server jars designed to act as virtual private servers (VPS) or hosting unrelated applications).
  7. Running servers that promote hate speech, harassment, discrimination, or violate Mojang's End User License Agreement (EULA).

10. Data Privacy and Protection

  1. Data Collection: We collect and process personal data as outlined in our Privacy Policy, in compliance with the General Data Protection Regulation (GDPR) and Lithuanian data protection laws.
  2. Data Security: We implement reasonable security measures to protect your data, but we cannot guarantee absolute security.
  3. Third-Party Access: We may provide data to third parties when required by law or to protect our rights and interests.

11. Intellectual Property

  1. Our IP: The MintServers name, logo, and all related software and technologies are our property or the property of our licensors.
  2. Your IP: You retain all rights to the content you create and host on your server.

12. Termination

  1. By Us: We may suspend or terminate your service for violations of these terms, non-payment, excessive resource usage, or any other reason at our discretion. For minor violations or non-payment, we will provide at least 7 days' notice before termination unless immediate action is required.
  2. By You: You may terminate your service at any time through your account dashboard.
  3. Data Retention: If your service is terminated, all data will be permanently deleted and cannot be recovered.

13. Limitation of Liability

  1. Service "As Is": Our services are provided "as is" without any warranties, express or implied.
  2. Damages: Our liability is limited to the amount paid for the service in the 12 months preceding the claim.
  3. Indirect Damages: We are not liable for any indirect, consequential, or incidental damages.

14. Indemnification

You agree to indemnify and hold harmless MintServers, its affiliates, and employees from any claims arising from your use of the service or violation of these terms.

15. Governing Law and Dispute Resolution

  1. Governing Law: These terms are governed by the laws of Lithuania.
  2. Dispute Resolution: Any disputes shall be resolved in the courts of Lithuania. Before pursuing legal action, both parties agree to attempt resolution through mediation facilitated by a neutral third party in Lithuania.

16. Changes to Terms

We may update these terms at any time. We will notify users of significant changes via email. Continued use of the service after changes constitutes acceptance of the updated terms.

17. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

19. Service Level Agreement (SLA)

  1. Service Uptime Guarantee: We aim to provide 99.9% uptime per calendar month. Scheduled maintenance and factors beyond our control (e.g., DDoS attacks) are excluded from this guarantee.
  2. Compensation: If uptime falls below 99%, affected users may request compensation in the form of account credits proportional to the downtime experienced.

20. Data Breaches

  1. Notification: We will notify affected users of any confirmed data breaches within 72 hours of discovery, as required by GDPR.
  2. Scope of Liability:
    • Our liability for data breaches is limited to cases of gross negligence or willful misconduct
    • Maximum compensation is limited to the amount paid for services in the previous 12 months
    • We are not liable for breaches resulting from user actions or third-party applications installed by users
  3. Security Measures: While we implement industry-standard security measures, we cannot guarantee absolute protection against sophisticated attacks or zero-day vulnerabilities.

21. Force Majeure

  1. Definition: We are not liable for service interruptions caused by circumstances beyond our reasonable control, including but not limited to:
    • Natural disasters or extreme weather events
    • War, terrorism, or civil unrest
    • Government actions or regulations
    • Major internet infrastructure failures
    • Widespread power outages
    • DDoS attacks exceeding our mitigation capabilities
    • Pandemics or other public health emergencies
  2. Duration: Force majeure protection extends only for the duration of the event plus reasonable recovery time.
  3. Communication: We will make reasonable efforts to keep users informed about service impacts during force majeure events.

22. Final Provisions

Your use of MintServers constitutes acceptance of these Terms of Service in their entirety. It is your responsibility to review these terms periodically for updates or changes.
